By accessing and using FAYNO ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
Permission is granted to temporarily use FAYNO for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password. You must notify us immediately of any unauthorized use of your account.
All content generated through FAYNO, including but not limited to images, prompts, and other materials, may be subject to intellectual property rights. You retain ownership of content you create, but grant FAYNO a license to use, store, and process such content as necessary to provide the Service.
User-Generated Content: FAYNO acts as a platform that facilitates content generation by users. All content generated through the Service is created by users, not by FAYNO. FAYNO does not claim ownership of user-generated content and is not responsible for the content generated by users. You, as the user, are solely responsible for ensuring that any content you generate does not infringe upon the rights of any third party, including but not limited to copyright, trademark, privacy, publicity, or other intellectual property rights.
FAYNO is not liable for any claims, damages, or expenses arising from user-generated content. If you believe that content generated through FAYNO infringes your rights, you must contact the user who generated such content directly. FAYNO reserves the right to remove content that violates these Terms or applicable laws, but assumes no obligation to do so.
You agree not to use the Service to generate content that:
FAYNO is provided "as is" and "as available" without any warranties of any kind. We do not guarantee that the Service will be available at all times, uninterrupted, secure, or error-free. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.
FAYNO operates on a credit-based system. Credits are purchased and used to generate images and access premium features. Credits are non-refundable except as required by law. We reserve the right to change pricing at any time, with reasonable notice to users.
Subscription Credits: Credits included with a subscription do not roll over to the next billing period. Unused subscription credits expire at the end of each billing cycle.
Package Credits: Credits purchased as one-time packages may be forfeited if your account remains inactive for more than 4 months and you do not have an active subscription. We reserve the right to remove unused package credits from inactive accounts after this period.
Refund Policy: Once you have started spending subscription credits or package credits after purchase, such credits and the associated purchase become non-refundable. Refunds may only be considered for unused credits within a reasonable timeframe and at our sole discretion, except as required by applicable law.
In no event shall FAYNO or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use FAYNO, even if FAYNO or a FAYNO authorized representative has been notified orally or in writing of the possibility of such damage.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
